Terms of Service

Nagare is an AI-assisted marketing platform that helps you plan, generate, schedule and publish social media content. Content is generated by AI and presented to you for review; you decide what is published. The Service is provided on an “as available” basis and may evolve over time.

• You must be at least 16 years old and able to enter into a binding contract.
• You are responsible for the accuracy of your account information and for keeping your credentials secure.
• You are responsible for all activity that happens under your account.

When you connect a social platform (e.g. Instagram, Facebook, X, LinkedIn, TikTok) or an AI/email provider, you authorize Nagare to act on your behalf only as needed to provide the Service, for example, publishing a post you approved. Your use of each third-party platform remains subject to that platform’s own terms and policies. You can disconnect any platform at any time, which revokes our access and deletes the stored credentials for it.

You agree not to use the Service to:

• break the law or any third-party platform’s rules;
• publish spam, misleading, hateful, infringing or otherwise unlawful content;
• impersonate others or misrepresent your affiliation;
• attempt to disrupt, reverse-engineer, overload or gain unauthorized access to the Service;
• use the Service to generate content you are not authorized to publish.

We may suspend or terminate accounts that violate these rules.

You retain all rights to the brand materials and content you provide or that we generate for you (“Your Content”). You grant Nagare a limited licence to process and transmit Your Content solely to operate the Service (including sending it to the AI and publishing providers you selected). You are responsible for ensuring you have the rights to any material you upload and for reviewing AI-generated content before it is published.

Content is produced by AI models and may contain errors, inaccuracies or material that needs editing. You are responsible for reviewing and approving anything before it goes live. Nagare does not guarantee any specific marketing result, reach, or engagement.

Some features are offered for free within usage limits. Paid plans are billed in advance through Stripe on a recurring basis and renew automatically at the end of each billing period until cancelled. Prices and what each plan includes are shown at checkout and in your account. Third-party costs you incur directly (for example, your own AI provider API usage) are your responsibility.

Cancellation. You can cancel your subscription at any time from your account settings or the billing portal. Cancellation takes effect at the end of the period you have already paid for: you keep access until then, and the amount already paid is not refunded.

Right of withdrawal (EU consumers). If you subscribe as a consumer, you would ordinarily have a 14-day right of withdrawal for distance contracts. The Service is a digital service supplied immediately after purchase: at checkout you expressly request that the supply begins at once and acknowledge that you thereby lose your right of withdrawal once the supply has begun (Art. 59 of the Italian Consumer Code, Legislative Decree 206/2005; Art. 16 of Directive 2011/83/EU). Where mandatory law nonetheless allows a withdrawal before the Service has been fully performed, you owe an amount proportional to the service already provided up to the moment of withdrawal. The right of withdrawal does not apply to purchases made for business or professional purposes.

The Service itself, its software, design, and branding, belongs to Nagare and its licensors. These Terms do not grant you any right to our trademarks or to copy or resell the Service.

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any content will be accurate.

To the maximum extent permitted by law, Nagare will not be liable for any indirect, incidental, special or consequential damages, or for loss of profits, data, goodwill, or reach, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law (including your mandatory consumer rights under EU/Italian law).

You can stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. On termination we delete your data as described in our Privacy Policy.

We may update these Terms as the Service evolves. We will update the “Last updated” date and, for material changes, notify you in-app or by email. Continued use after changes take effect means you accept the updated Terms.

These Terms are governed by Italian law, without prejudice to any mandatory consumer-protection rights you have in your country of residence. Disputes are subject to the competent courts, unless mandatory law provides otherwise.
